Drowning

A death of an employee occurred on or in the Ohio River. The death is still under investigation & the autopsy report has not been released. The cause is unknown at this time. Report is being filed under protest due to jurisdictional issues yet resolved. The deceased was working on empty barge when last seen. Upon his disappearance, a search commenced & his body found approx 2:30am.

IE was lowering a 20'x3' corrugated metal panel using a rope and well-pulley. A sudden gust of wind blew the panel and the employee reacted by trying to wrap right arm around the rope on the panel-side and grab the rope with their hand. The rope got between their fingers instead & the twisting/pulling rope twisted their hand and fractured 4th metacarpal shaft of right hand.

Absorption of radiations, caustics, toxic and noxious substances

Employee was trying to move a garter snake from the work area when they were reportedly bitten. The incident was not the result of any compliance issues nor were any protective guards involved.

Struck against stationary object

A fully trained miner was walking under the 104 Belt when EE struck head on the belt guarding causing pain in the neck and left arm. The accident was not a result of any compliance issues nor were any protective guards involved.

Caught in, under or between a moving and a stationary object

A fully trained miner was injured when releasing a breast line on a barge. The barge drifted and caught the employee's hand between the line and the barge. This was not a result of any compliance issues nor were any protective devices involved.

Struck by flying object

EE was delivering stone to the location for Lincoln Contracting. As the bed of the truck was being lowered electricity from the powerline allegedly arced striking the bed of the truck. Upon inspecting for fire at the right rear of the truck, the right front tire exploded striking EE with debris. MSHA jurisdiction is in question by Marshall County Coal Company.

Victim was found sitting in a chair in the building called the ""One Car Garage"". CPR was initiated by the person who found him non-responsive and with no pulse. It was determined by a medical examiner that he had a MASSIVE HEART ATTACK. Is not a work related injury/illness death. Cause of this death was a massive heart attack while the person was sitting in a chair.

Fall to the walkway or working surface

Employee stepped off barge to tow boat and slipped on ice on the deck of the tow boat. Employee fell hitting left shoulder. Employee continued to work and did not miss work until 2/8/2011. Employee went off work for left shoulder surgery on 2/8/2011

Over-exertion in lifting objects

On 12/31/09, EE dropped a 2"" pivot line off the end of a barge, the weight of the line pulled his left shoulder, causing pain. EE returned to work the next scheduled shift, but began missing work on 1/7/10, McElroy was informed EE was off work due to a work related injury, via a WC-1 on 1/14/10. Now determined to be a reportable incident.

Over-exertion in lifting objects

On 9/15/09, EE was putting cable over a timber head, when he felt a pain in his right shoulder. He returned to work on his next scheduled shift and began missing work on 1/14/10. Now determined to be a reportable incident.

Over-exertion in wielding or throwing objects

While throwing slack off of pivot line, employee felt a pain in his lower back.

Employee was atttaching the up river breast line to a barge when is left index finger became caught between the winch rope and the barge.

IRELAND RIVER LOADING FACILITY SAMPLE BUILDING. MAN WAS CLEANING OUT CHUTE. HE REACHED UP IN TERTIARY CUTTER ENCLOSURE - WHEN THE TIMER CAUSED THE CUTTER MECHANISM TO MOVE. THIS CAUGHT THE VI CTIM'S FOREARM BETWEEN CUTTER ARM AND THE SIDE OF THE ENCLOSURE.

TRAVK ENTRY NEAR ROCKDUST CHUTE. EQUIPMENT MOVE WAS OFF TRACK. MAN WAS HELPING TO PUT A DRAW BARON TO A DOLLY AND A LOCOMOTIVE TO PULL BACK ON TRACK PIN- HE WAS INSERTING THROUGH BAR WAS BENT. LOCOMOTIVE COASTED, HIS FINGER WAS CAUGHT BETWEEN PIN AND LOCOMOTIVE.

LIGHTNING STRUCK DECKHAND ON A BARGE IN THE VICINITY OF THE IRELAND RIVER LOADING FACILITY. THISINCIDENT DID NOT OCCUR ON MSHA REPRESENTED PROPERTY THE ACCIDENT WAS ON COAST GUARD REPRESENTED PROPERTY & A PROPER ACCIDENT REPORT WAS SUBMITTED TO THEM & ACCEPTED BY THEM THIS 7000-1 REPORT IS BEING FILED AT THE DIRECTION OF MSHA & SUBMITTED UNDER PROTEST
