An excessive rain event washed out a roadway. The roadway is located at a remote location on the mine site that is not active and is restricted to light vehicles only during periodic site inspections.

EMPLOYEE ALLEGES THAT HE WAS CUTTING A BELT WHEN THE BELT STARTED RESULTING IN FRACTURES AND LACERATION TO THE TOP OF HIS LEFT HAND.

Strained Back, Initially viewed as a re-injury of 12/6/10 by Gallager Bassett. Employee now hired legal representation and Third Party Gallager Bassett advised new claim to be opened due to ch enge in legal status. Our first knowledge was on 05/02/11. Thus this filing. MSHA Notified by phone of this and advised this statement be entered.

Employee was assisting in the replacement of the diaphram toggle assembly in the jaw crusher. He had cleaned the crank case with brakeleen before installing the toggle assembly. The employee had a cigarette in his left hand when he turned to pick up a rag. The cigarette ignited the fumes.
